El siguiente artículo presenta elementos conceptuales y analíticos que nos permitan ampliar el debate sobre la legalización de la minería en Colombia. Buscamos elementos que permitan plantear alternativas para consolidar un nuevo proceso de minería sustentable social y ambientalmente, que reivindique el valor de las prácticas ancestrales y las formas redistributivas de la producción. Para ello es necesario iniciar con la discusión sobre los conceptos de formalización y legalidad, de manera que podamos generar un marco teórico que nos permita explorar tan delicado asunto. Continuaremos presentando el marco sociopolítico en el que se basa dicha estrategia; Luego presentamos un breve contexto de la reformulación legal de la minería, concentrando nuestra atención particularmente en la normatividad que involucra o tiene efectos sobre la minería artesanal y/o minería a pequeña escala. Allí nos encontraremos con un debate sobre la tipología de la minería y las dificultades que se presentan en la actualidad para definir esquemas de legalización o formalización de la pequeña minería en Colombia. Para concluir con una propuesta de formalización como mecanismo de transición hacia un sistema administrativo- legislativo que se conecte más eficientemente con las realidades y habilidades de las comunidades étnicas que practican la minería a pequeña escala.
The following article presents conceptual and analytical elements that allow us to broaden the debate about the legalization of the mining in Colombia. Looking for items to be able to propose alternatives in order to consolidate a new mining process socially and environmentally sustainable, claiming the value of the ancestral practices and forms of the redistributive production. To this end, it is necessary to start with the discussion of the concepts of formalization and legality, so that we can generate a theoretical framework that will allow us to explore such delicate matter, we will continue to make the framework socio-political , in which it is based that strategy. Then there is a brief context of the reformulation of legal mining, focusing our attention particularly standards which involves or has effects on artisanal mining and/or small-scale mining. There we will find ourselves with a debate on the typology of the mining and the current difficulties to define schemas of legalization or formalization of small-scale mining in Colombia. To conclude with a proposal to formalize as a mechanism of transition to an administrative system – legislative that will connect more effectively with the realities and skills of the ethnic communities that practice small-scale mining.
