| Description: | En el siguiente trabajo se buscó realizar un análisis comparativo del reciente marco legal migratorio de Sudáfrica y Argentina. Dicho análisis tuvo por objetivo plantear que si bien ambos países se caracterizan por tener a los Derechos Humanos como una política de Estado, los mismos no son aplicados de una manera coherente en la implementación de sus respectivas políticas migratorias, donde prevalece la lógica de sus modelos de desarrollo y acumulación económica, por sobre la protección de los derechos de los migrantes. Por otro lado, a partir de la comparación de ambos casos, se pudo vislumbrar cómo las promulgaciones de nuevas leyes migratorias también
respondieron a la necesidad de dar respuesta a nuevas reconfiguraciones identitarias que se estaban dando en las sociedades de dichos países, más allá del intento de gestionar los nuevos flujos migratorios provenientes mayoritariamente de sus países limítrofes. In the following work is sought to make a comparative analysis of the recent immigration legal framework of South Africa and Argentina.The objective of this analysis was to establish that, although both countries are characterized by having Human Rights as a State policy, they are not applied in a coherent way in the implementation of their respective migratory policies, where the logic of their models prevails Development and economic accumulation, over the protection of the rights of migrants. On the other hand, from the comparison of both cases it was possible to see how the promulgations of new immigration laws were also an effect of the need to respond to new identity reconfigurations that were taking place in the societies of those countries, beyond Attempt to manage the new migratory flows coming mainly from neighboring countries. |
