| Resumen / Abstract : | ¿Las lógicas securitarias deben guiar las reformas legislativas que afectan al órgano de investigaciones criminalísticas? ¿Estas deben afectar también la dirección que ejerce el Ministerio Público sobre la investigación penal? ¿El órgano de investigaciones debe ser considerado como una Policía más? O, por el contrario, ¿tiene características propias que le diferencian de la institución policial? ¿La investigación penal debe ser entendida como parte del servicio de Policía o como una fase del proceso penal? En este trabajo se intentan hacer estas reflexiones desde el contexto venezolano, analizando críticamente la reciente legislación que ha introducido modi¬ficaciones en estas materias. Should securitarian logic guide legislative reforms that affect the body for criminalist investigations? Should it also affect the leadership that the Public Prosecutor exercises over criminal investigation? Should the body for investigations be considered as just another police force? Or, on the contrary, does it have its own characteristics that distinguish it from the police institution? Should penal investigation be understood as part of the police service or as a phase in the penal process? In this work, some reflections are attempted from the Venezuelan context, analyzing critically the recent legislation that has introduced modifications in these matters. |
