Las obligaciones asumidas por el Estado de derecho comprenden el desarrollo de acciones en al menos dos aspectos complementarios. Uno, para no impedir u obstaculizar el acceso a garantías, y otro fundamentalmente positivo de organizar y desarrollar con eficiencia el aparato institucional público que permita que las personas puedan acceder a los derechos. Dentro de este marco, se desprende una obligación que requiere la acción efectiva del Estado de remover las barreras y los obstáculos normativos, sociales, culturales o económicos que limitan o impiden el acceso a la justicia, en especial en aquellas sociedades que padecen brechas amplias de desigualdad. El acceso a la justicia precisamente puede plantearse como la acción afirmativa del Estado dirigida a producir la disponibilidad real de los medios o recursos necesarios para hacer valer los derechos y garantías que dicta la Constitución, con resultados individual y socialmente justos. En este sentido, el principio de “igualdad de oportunidades” atraviesa a esta concepción: igualdad para acceder a las instituciones, órganos y poderes del Estado que generan, aplican o interpretan leyes y regulaciones normativas que tendrán especial impacto en el bienestar social y económico de las personas de escasos recursos. Desde esta perspectiva, el acceso al sistema de administración de justicia constituye una parte fundamental de una política de inclusión social, razón por la cual los poderes del Estado, deberán coordinar las políticas públicas necesarias para llevarlo adelante. Sin embargo, el funcionamiento desarticulado de las instituciones expone un nivel de crisis sobre el sistema de administración de justicia, que impacta de manera negativa sobre el conjunto de la sociedad y deja en evidencia la necesidad de afrontar reformas y las diversas resistencias de los sectores involucrados. The obligations assumed by the rule of law include the development of actions in at least two complementary aspects. One, not to prevent or hinder access to guarantees, and the other fundamentally positive, to efficiently organize and develop the public institutional apparatus that allows people to access rights. Within this framework, an obligation emerges that requires the effective action of the State to remove the regulatory, social, cultural or economic barriers and obstacles that limit or prevent access to justice, especially in those societies that suffer from wide inequality gaps. Access to justice can be considered precisely as the affirmative action of the State aimed at producing the real availability of the necessary means or resources to assert the rights and guarantees dictated by the Constitution, with individual and socially fair results. In this sense, the principle of “equal opportunities” cuts across this conception: equal access to the institutions, bodies and powers of the State that generate, apply or interpret laws and normative regulations that will have a special impact on the social and economic well-being of lowincome people. From this perspective, access to the justice administration system constitutes a fundamental part of a social inclusion policy, which is why the powers of the State must coordinate the necessary public policies to carry it out. However, the disjointed functioning of the institutions exposes a level of crisis on the justice administration system, which has a negative impact on society as a whole and reveals the need to face reforms, and the various resistances of the sectors involved.
