Este artículo tiene por objetivo abordar los recientes cambios operados en la política migratoria argentina, con especial énfasis en las modificaciones introducidas por el Decreto de Necesidad y Urgencia (DNU) 70 (de enero de 2017), con vistas a iluminar los vínculos actuales entre migraciones, derechos humanos y seguridad. El caso argentino resulta de especial interés porque la Ley Migratoria vigente desde 2004 incorpora importantes estándares de derechos humanos, que deberían funcionar como límite al avance de ciertas prerrogativas soberanas del Estado en nombre la seguridad.
The goal of this paper is to address recent changes over Argentine migration policy, particularly reforms introduced by the Necessity and Urgency Decree (Decreto de Necesidad y Urgencia-DNU) 70, issued by the executive branch in January 2017, to highlight the current links between migrations, human rights and security. Argentina’s case is of the most importance given that its Migration Law (from 2004) has recognized the highest standards on human rights, which should limit certain actions of the State taken in the name of security.
Este artigo tem por objetivo abordar as recentes mudanças operadas na política migratória argentina, com especial ênfase nas modificações introduzidas pelo "Decreto de Necesidad y Urgencia", (DNU) 70 (de janeiro de 2017), com vistas a iluminar os vínculos atuais entre migrações, direitos humanos e segurança. O caso argentino resulta de especial interesse porque sua lei migratória vigente incorpora importantes parámetros de direitos humanos que deveriam funcionar como limite ao avanço de certas prerrogativas soberanas do Estado em nome da segurança.
