In the following work is sought to make a comparative analysis of the recent immigration legal framework of South Africa and Argentina. The objective of this analysis was to establish that, although both countries are characterized by having Human Rights as a State policy, they are not applied in a coherent way in the implementation of their respective migratory policies, where the logic of their models prevails Development and economic accumulation, over the protection of the rights of migrants. On the other hand, from the comparison of both cases it was possible to see how the promulgations of new immigration laws were also an effect of the need to respond to new identity reconfigurations that were taking place in the societies of those countries, beyond Attempt to manage the new migratory flows coming mainly from neighboring countries.
