Description
Si el Estado de Derecho supuso la eliminación de la arbitrariedad y autoritaria organización de la sociedad del antiguo régimen, el Estado Social de Derecho implica un avance histórico de la humanidad en tanto a más de establecer la igualdad y limitar el poder del Estado, asume la igualdad real y regula la propiedad privada sujetándola al interés social e incorpora los Derechos Económicos Sociales y Culturales, como fundamento reconocido de la constitucionalidad del régimen de gobierno. La igualdad debe ser también reconocida como el derecho a la diferencia y a la no discriminación.
