Haciendo uso de la versión de Laclau y Mouffe de la categoría gramsciana “hegemonía”, el objetivo del presente artículo es destacar la posibilidad de un análisis post estructuralista del derecho en el que la arena judicial se convierte en escenario de una disputa hegemónica. Según Laclau y Mouffe, esta disputa sería el movimiento político por excelencia, que se manifiesta tanto en la política hecha por movimientos sociales en las calles, como en la política hecha en los poderes Ejecutivo, Legislativo y, de acuerdo con lo que se defiende en este artículo, en el poder Judicial.
Using the Laclau and Mouffe version for the Gramscian category “hegemony,” the aim of this article is to highlight the possibility of a post-structuralist analysis of law in which the judicial arena becomes the background for a hegemonic dispute. According to Laclau and Mouffe, this dispute would be the main feature of the political movement, manifested in politics made by social movements in the street and politics made in the executive and legislative branches; and according to what is defended in this article, also in the judiciary.
