Discutir la estructura de la magistratura argentina es una cuestión política. En las dos funciones primarias del judicial (resolución de conflictos y control de constitucionalidad) son manifiestas graves deficiencias: en especial falta de una casación nacional y debilidad extrema del control constitucional. Considerando los tres modelos de estructuras más comunes en el mundo (norteamericano, europeo continental y latinoamericano), el nuestro no responde a ninguno de ellos. Dada la irracionalidad de nuestro modelo, es posible ensayar una reforma en dos etapas, que nos acerque al modelo europeo: una en el marco de la Constitución vigente, que se podría coronar en una futura reforma constitucional.
Discussing the structure of the Argentine judiciary is a political issue. In the two primary functions of the judiciary (conflict resolution and control of constitutionality) serious deficiencies are evident: especially the lack of a national cassation and extreme weakness of constitutional control. Considering the three most common models of structures in the world (North American, continental European and Latin American), ours does not respond to any of them. Given the irrationality of our model, it is possible to test a reform in two stages, which brings us closer to the European model: one within the framework of the current Constitution, which could be crowned in a future constitutional reform.
