Description
La presencia de N. Bobbio en la actualidad del panorama filosófico del derecho es innegable. Desde sus inicios el pensamiento político y social de este autor traza una correlación directa con las principales teorías del positivismo, realismo y la fenomenología. El ensayo presenta las etapas evolutivas de sus ideas jurídicas y como éstas han contribuido al desarrollo de una sociedad más tolerante, plural y democrática capaz de orientar las fuerzas del poder del Estado hacia una convivencia humana liberada de la violencia y en mayor convivencia pacífica. La tesis de Bobbio sobre los Derechos Humanos representa uno de los avances más innovadores donde las normas jurídicas deben estar al servicio del Bien y de la libertad.
The presence of N. Bobbio in the current philosophical panorama of law is undeniable. Since its beginnings, the political and social thought of this author has drawn a direct correlation with the principle theories of positivism, realism and phenomenology. This essay presents the evolutionary stages Bobbian legal ideas and how these have contributed to the development of a more tolerant, plural and democratic society, able to guide the forces of State power toward human coexistence liberated from violence and with greater peaceful coexistence. Bobbio’s thesis on human rights represents one of the most innovative advances, where legal norms are at the service of good and freedom.
