En este trabajo de investigación se analizaron y evaluaron las políticas públicas de transparencia gubernamental seguidas por el Ayuntamiento de Guaymas, Sonora, para satisfacer el derecho al acceso a la información pública y a los datos personales que genera y obran en su poder o resguardo, respectivamente, bajo una mirada comparativa, tomando como variables por una parte la Ley de Acceso a la Información Publica en el Estado y las reglas municipales, al respecto y por otra, el Código de Buenas Prácticas y Alternativas para el Diseño de Leyes de Transparencia y Acceso a la Información Pública (CBP), elaborado a solicitud del Instituto Federal de Acceso a la Información Pública por el Centro de Investigación y Docencia Económicas y el Instituto de Investigaciones Jurídicas de la UNAM, como patrón/muestra.
In this research work, the public policies of government transparency followed by the City Council of Guaymas, Sonora, to meet the right of access to public information and the personal data that it generates and that are in its possession and custody, were analyzed and evaluated, respectively, through a comparative approach, taking as variables, on the one hand, the Law of Access to Public Information in the State and the relevant municipal rules and, on the other hand, the Code of Good Practices and Alternatives for the Design of Laws of Transparency and Access to Public Information (CBP), prepared upon request of the Federal Institute of Access to Public Information by the Center for Economic Research and Teaching and UNAM’s Juridical Research Institute as a pattern/sample. Along this pathway, we find that noncompliance of the state and municipal regulations with the provisions contained in the second paragraph of the sixth article of the constitution, on the one hand; distrust and disbelief by citizens, on the other hand and, finally, the lack of political update, willingness and disposition of the local institutions and officers make the three sides of a triangle that encloses the simulation of public policies in matters of government transparency, which in practice do not meet the right of access to public information and, much less, to the personal data under its custody and administration. Let’s hope that this effort will be helpful in improving the understanding of what is happening with the public policies in their underlying developmental ground, within that organizational sphere called municipality, where most of the beneficiaries/injured parties that are the recipients of said policies are located and which is also the space where citizenship should be developed.
