El tema central de esta tesis es determinar qué factores explican la judicialización de la política en cortes y tribunales constitucionales de América Latina. Su respuesta se solventa por la arquitectura institucional de las cortes, la cultura legal interna en los jueces y por la movilización legal en los tribunales de justicia. El primer factor entiende que el diseño formal de los órganos constitucionales permite o no judicializar la política (Sieder et al. 2011). La idea asumida en el campo de iure es que mediante las reglas se configura el poder de acción que las entidades constitucionales poseen y que (en efecto) aplicarían al judicializar la política.
