En América Latina, la legislación restrictiva sobre aborto representa una de las expresiones más relevantes sobre desigualdad de género/clase. Las leyes sobre aborto legal han sido las más difíciles de adoptar entre las llamadas reformas sobre derechos de las mujeres. Dado su carácter doctrinario, la literatura ha señalado que las reformas sobre aborto legal solo se adoptan tras la agencia intensa de los actores reformistas en contextos progresistas. Mediante el estudio en profundidad del caso chileno, este artículo ilustra el trabajoso proceso de adopción de estas leyes y destaca que tres factores fueron decisivos: el lobby activo de las mujeres de los partidos de centro-izquierda, la agencia de la presidenta socialista Bachelet, y una mayoría de centro-izquierda en el Congreso.In Latin America, the prohibition of induced abortion represents one of the most significant expressions of gender and class inequality. Legal abortion laws have been the most difficult to pass among the so-called women’s rights reforms. Due to the doctrinal nature of these laws, previous research has pointed out they can only be adopted as consequence of the intense agency of the reformist actors within a progressive political context. This article illustrates the arduous process of adopting these laws through an in-depth analysis of the Chilean case. The paper highlights the decisiveness of three factors: the active lobby of women from center-left parties, the agency of socialist President Michelle Bachelet, and the center-left majority in Congress.
