Los derechos de la naturaleza nacen en el constitucionalismo interculturalizado de Ecuador en el año 2008. Podemos definirlos como un conjunto de normas que promueven el respeto integral a la existencia, la estructura, las funciones y sus procesos evolutivos, así como, al mantenimiento y la regeneración de sus ciclos vitales. Este reconocimiento histórico y jurídico, se convirtió en un punto de encuentro entre los movimientos ecologistas y el movimiento indígena ecuatoriano en el proceso constituyente. También existen otros países que, por distintas vías, han logrado reconocer los derechos de la naturaleza, como Colombia, la India y Nueva Zelanda.
