En este trabajo se argumenta que la justicia penal se ha universalizado y muestra como prueba de ello la creación de la Corte Penal Internacional y los tribunales internacionales para la Ex Yugoslavia y Ruanda como antecedentes de aquella. El trabajo arroja como hallazgos que la justicia penal, justicia conforme el concepto de la Escuela Inglesa, ha superado los principios de internacionalización y se ha consagrado como universal, que la conformación de los Tribunales Penales Internacionales para la ex Yugoslavia y Ruanda y la creación de la Corte Penal Internacional son regímenes internacionales que consagran su actuación en base a leyes internacionales y estructuras normativas que crean un compromiso directo entre los estados e individuos que los integran, regulando su comportamiento y derivando la administración de la justicia penal más allá de las esferas domésticas.
