La enseñanza del pasado reciente relacionada con la última dictadura cívico-militar en Uruguay ha sido un tema de debate y controversia desde la instauración de la democracia en 1985 en el país. Dicha enseñanza tiene su antecedente en 1988, en el programa de Historia de ciclo básico, pero fue en el año 2005 cuando se la incorporó con una mirada a largo plazo en los programas de primaria, secundaria y Formación Docente. Sin embargo, en los diferentes programas de la disciplina del Derecho, en particular de la asignatura Educación Social y Cívica de la Reformulación 2006, la enseñanza del pasado reciente no se explicita, a pesar de contener unidades curriculares que se interrelacionan con importantes aspectos vinculados a ese pasado dictatorial. Por tal motivo, la presente investigación indaga acerca de las posibilidades pedagógicas que ofrece el programa de tercer año de la asignatura de referencia, para abordar desde lo socio-jurídico dicha enseñanza. Las interrogantes que guiaron el análisis son las siguientes: ¿la docencia del profesorado de Derecho enseña el pasado reciente en relación con la dictadura cívico-militar?, ¿vincula ese pasado con algunas de las unidades del programa de Educación Social y Cívica?, ¿qué estrategias utilizan para enseñar?, ¿cómo fundamenta su enseñanza ante un programa que omite dicho contenido? La tesis tiene una metodología cualitativa mixta basada en análisis documental, en la realización de entrevistas y la observación de una práctica docente por parte de una profesora de Derecho a cargo de grupos de tercer año de la asignatura de referencia, en uno de los dos liceos públicos de Montevideo seleccionados para el trabajo de campo. La investigación demostró que parte de la docencia de Derecho supera los supuestos programáticos establecidos en los planes de asignatura, evidenciando las posibilidades que tiene la disciplina, especialmente la asignatura Educación Social y Cívica, para enseñar el pasado reciente relacionado con la última dictadura cívico-militar en Uruguay y que su enseñar depende más de la postura docente ante dicho aprendizaje, que de lo que explícita u omite un currículum.The teaching of the recent past, related to the last civilian-military dictatorship in Uruguay, has been a matter of debate and controversy since the establishment of democracy in 1985 in the country of reference. That teaching has its precedent in 1988, in the History syllabus of the first grades of Secondary Education, but it was in 2005 that it was incorporated, with a long-term view, into the Syllabuses of Primary, Secondary Education and Teacher Training. However, from the different Syllabuses related to Law, from the subject Social and Civic Education in 2006 Reformulation, that teaching was not explicit in the curriculum, in spite of having theme units and contents that were closely linked to the central topic of this research. This research emerges from the pedagogical possibilities that the 3rd grade program of the referential subject offers, with its didactic specificity, social and legal knowledge for the teaching of the recent past. Does the educational staff in the Law teaching career foster learning about the recent past? Is the recent past linked to the Social and Civic unit about Human Rights? Is the recent past related and taught with other types of knowledge in the subject of third grade? What strategies are used to teach it? How is that teaching underlain considering the Syllabus omits that content? These are the main points from where the research emerges, they are analyzed from discourses and the observation of the teaching practice of Law teachers who are in charge of third grade groups in the subject Social and Civic Education, in two state high schools from Montevideo. The thesis has a mixed qualitative methodology that emerges from the possibilities of Law teachers training about the recent past, related to the last coup d’état in Uruguay. The research reported that part of the Law teaching exceeded the syllabus assumptions established for this subject plan. These discipline possibilities, and in particular the subject Social and Civic Education, to teach the recent past related to the last civilian-military dictatorship in Uruguay became evident. It also revealed that its teaching depends more on the teacher’s stance towards that learning than what is made explicit or is omitted in a curriculum.
