En los últimos años, Ecuador ha sufrido importantes cambios institucionales, jurídicos y sociales. Esos cambios han sido significativos para grupos históricamente excluidos, tales como las personas lesbianas, gays, bisexuales, transgénero, e intersexuales (LGBTI). En virtud de lo anterior, es pertinente analizar cómo esos cambios sociales, jurídicos e institucionales han tenido impacto en las condiciones de vida de las personas, de manera que se pueda establecer si efectivamente hay avances reales o si
han sido ilusorios.
A pesar del reconocimiento de un importante catálogo de derechos, las personas
LGBT siguen siendo susceptibles de sufrir actos de violencia, debido a la existencia de un sistema heteronormativo que rechaza a quienes se apartan de los parámetros y mandatos de dicho sistema. Las personas con sexualidades periféricas, es decir, aquellas que no cumplen con el patrón normativo heterosexual, son propensas a ciertos tipos de violencia y en muchos casos enfrentan nuevas formas de negación y exclusión cuando emprenden procesos judiciales en búsqueda de justicia.
